ForeverVoice – Terms of Service

Welcome to ForeverVoice (“ForeverVoice,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of the ForeverVoice website, web application, services, and features (collectively, the “Service”).
By creating an account, accessing, or using the Service, you agree to be bound by these Terms.

If you do not agree, do not use ForeverVoice.

 

1. Eligibility

You must be at least 16 years old (or the minimum age in your region) to use ForeverVoice.
If you are using the Service on behalf of another person or organization, you represent that you have the authority to do so.

 

2. Description of the Service

ForeverVoice allows users to:

• Create memorial or personal profiles
• Upload text, images, and audio recordings
• Record legacy messages or letters
• Store memories and personal information
• Access AI-assisted prompts (where applicable)
• Share profiles publicly or privately
• Send legacy emails through our SMTP system
• Access additional premium features depending on your membership plan

ForeverVoice is not a legal service and does not provide legal, financial, or estate-planning advice. You are responsible for consulting qualified professionals for legal matters relating to wills, trusts, or estate planning.

 

3. User Accounts

To use ForeverVoice, you must create an account. You agree to:

• Provide accurate information
• Keep your login credentials secure
• Be responsible for all activity under your account

We may suspend or terminate accounts for misuse or violations of these Terms.

 

4. Early Access & Feature Availability

ForeverVoice is in ongoing development and may release features gradually.
Certain features may change, be added, or be removed.
By using the Service, you understand that:

• Some features may be experimental
• Some functions may not yet be fully optimized
• We may request feedback from early users

We do not guarantee uninterrupted availability.

 

5. Memberships & Payments

ForeverVoice may offer:

• Paid memberships (e.g., $100) with premium features

Prices, features, and plans are subject to change.
Taxes may apply depending on your region.

By purchasing a membership, you authorize us (and our payment processors) to charge the applicable fees to your payment method.

 

6. Refund Policy

ForeverVoice does not offer refunds except where required by law.
All purchases are final unless a refund obligation applies under your regional consumer protection rules.

7. User Content

You retain ownership rights of any content you upload, including:

• Voice recordings
• Text
• Images
• Notes
• Legacy letters
• Memorial information

By uploading content, you grant ForeverVoice a limited, worldwide, royalty-free non-exclusive license to:

• Host, store, process, reproduce, and display your content
• Provide the Service to you
• Send messages on your behalf (e.g., legacy letters)
• Back up content securely

This license does NOT permit ForeverVoice to:

·         sell your content

·         use your voice or likeness for advertising

·         use your content outside the platform without your consent

·         create derivative AI models from your recordings unless explicitly authorized

You retain full ownership of all content you upload.

We do not claim ownership of your content.

You are responsible for ensuring you have the rights to upload anything you submit.

 

8. Privacy and Data Security

Your privacy is extremely important to us.

Security Summary

• Data is encrypted in transit (HTTPS/TLS).
• Data is encrypted at rest on our hosting provider’s servers (Hostinger).
• Passwords are hashed and salted.
• Authorized staff may access profile data only when needed for support, moderation, or technical maintenance.
• We do not provide end-to-end or zero-access encryption at this time.

 

9. Acceptable Use

You agree NOT to:

• Use ForeverVoice for illegal purposes
• Upload harmful, abusive, or misleading content
• Upload content you do not have the right to share
• Attempt to breach or bypass our security systems
• Tamper with the Service, reverse engineer it, or misuse the platform

We may remove content or suspend your account for violations.

 

10. Legacy Letters & Deliverability

ForeverVoice allows users to schedule or send legacy messages via email.
You acknowledge that:

• Deliverability may depend on external email providers
• We are not responsible for spam filtering, blocking, or delays
• You must enter correct recipient email addresses

We do not guarantee delivery success for every external email provider.

 

11. Intellectual Property

ForeverVoice owns all rights to:

• Website and app design
• Branding, logos, and trademarks
• Software, systems, and platform code
• AI-generated prompts or automated suggestions

You may not copy, distribute, or reproduce any part of the Service without permission.

 

12. Termination

We may suspend or terminate your access if:

• You violate the Terms
• You misuse the service
• Your account remains inactive or abandoned
• We are required to by law or security concerns

You may also delete your account at any time.

 

13. Disclaimers

ForeverVoice is provided “as is” without warranties of any kind.
We do not guarantee:

• Accuracy of user-generated content
• Delivery of legacy messages
• Continuous uptime
• Suitability for legal or estate planning purposes

You use the Service at your own risk.

 

14. Limitation of Liability

To the maximum extent permitted by law, ForeverVoice and its team are not liable for:

• Data loss
• Service interruptions
• Indirect or consequential damages
• Content uploaded by users
• Issues related to your estate, will, or personal legal affairs

Our total liability will not exceed the amount you paid for the Service in the past 12 months.

 

15. Changes to the Terms

We may update these Terms from time to time.
If changes are significant, we will notify users by email or through the app.

Continuing to use the Service means you accept the updated Terms.
